I hereby assume all the risks of participating in boxing and/or any other form of physical activity (hereinafter ‘program’ offered by Legendary Boxing and Fitness, located at 2051 Smith Street, North Providence, RI (hereinafter ‘Legendary’) including but not limited to any risks that may arise from negligence or carelessness on the part of persons entities being released, from dangerous or defective equipment or property, owned, maintained or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit, have sufficiently prepared or trained for participation in the programs, activities or events offered by Legendary, and have not been advised not to participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these programs, activities, or events onsite/offsite Legendary premises. I acknowledge that I am required to provide my own medical coverage, and that Legendary will not be held liable for any expenses incurred for treatment of injuries suffered while participating in these programs, activities or events.
I acknowledge that this Waiver and Release of Liability form will be used by Legendary, its program instructors, trainers, and their affiliates, and that it will govern my actions and responsibilities at said programs, activities or events.
In consideration of my agreement with Legendary, and permitting me to participate in these programs, I, on behalf of myself, any family member or those I am responsible for while participating in any and all programs at Legendary, and my executors, administrators, heirs, next of kin, successors, and assigns do hereby:
A) Waive, release, and discharge Legendary, and their respective sponsors, employees, directors, agents, servants, and volunteers from any and all claims for death, personal injury, property damage, which may hereafter accrue to me as a result of participation in any program at Legendary.
B) Indemnify, hold harmless, and promise not to sue Legendary, and their respective sponsors, employees, directors, agents, servants, and volunteers from any and all claims for death, personal injury, property damage, which may hereafter accrue to me as a result of participation in any program at Legendary.
This release is intended to discharge in advance Legendary, and their respective sponsors, employees, directors, agents, servants, and volunteers, assigns from any and all claims for death, personal injury, property damage, which I or any family member or other person I am responsible for may suffer from, and against any and all liability arising out of or in connection with my participation in any program at Legendary, even though that liability may arise out of the negligence or carelessness on the part of the persons or entities being released. Legendary is not responsible for any property left on the premises at any time during or after business hours.
This release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I hereby give permission for our images captured during regular and special activities through video, photo and digital camera to be solely for the purpose of promoting Legendary. Legendary has my permission to use these images from time to time in Legendary websites, social media pages, brochures, newsletters and correspondence, and I expressly waive any right of compensation or ownership thereto.
